Service Agreement (Updated 6/24/2020, Effective 06/24/2020) This signed agreement must be provided to Executive Pet Services, LLC before service is provided for any period. Executive Pet Services, LLC cannot complete services without this agreement. IF YOU DO NOT AGREE TO THE FOLLOWING TERMS, DO NOT SIGN THIS DOCUMENT AND DO NOT USE OUR SERVICES.
DEFINITIONS:
For the purposes of this document, the terms Client, Owner, Pet Owner, and Customer are synonymous with the person contracting services for one or more domestic animals.
For the purposes of this document, the terms We, Us, Company and ExecuPets are synonymous with Executive Pet Services, LLC
For the purposes of this document, the terms Pet Sitter, Sitter, Staff, Employee and Pet Care Specialist are synonymous with any individual contracted, employed by or an agent of Executive Pet Services, LLC.
MEMBERSHIP DOG WALKING is defined as 3 or more dog walking services scheduled per week, on an on going, assumable perpetual basis, scheduled in a set time frame for each of those days.
DOG WALKING SUBSCRIPTIONS are defined as whole-month of Monday through Friday services at a set service fee regardless of number of service days in a month, cancellations or holidays. Holidays and weekends are not included in Dog Walking Subscriptions.
AD HOC DOG WALKING, also referred to as "As Needed Dog Walking" visits are defined as 1 or more walks scheduled outside of or not part of a membership in an "as-needed" fashion.
PACK ADVANTAGE or PACKAGED DOG WALKING visits are defined as any walk belonging to a bulk purchase package, but not part of a membership.
PET SITTING and OVERNIGHT visits are defined as part of a "one-time series" of one or more subsequent visits, over a predefined period such as 5 days or one week for the care of one more animals belonging to the client while they are away from home.
Service Fee:
o MEMBERSHIP DOG WALKING:
To guarantee your reservations, clients booking a monthly membership must pay for the first month at the time of booking. Subsequent months must be paid by the due date on each month's invoice.
o SUBSCRIPTION DOG WALKING:
To guarantee your reservations, clients booking subscription dog walking must pay for the first period at the time of booking. Subsequent periods must be paid by the due date on each period's invoice. A period is defined as a regularly occurring set fee. (ex. Weekly, Monthly, Quarterly, or Yearly).
o AD HOC DOG WALKING:
To guarantee your reservations we require 100% of our service fee at the time of booking. Invoices will be generated upon acceptance of your reservation.
o PACK ADVANTAGE or PACKAGED DOG WALKING:
100% of the purchase amount of the package is due at the time of purchase.
o PET SITTING VISITS AND OVERNIGHT SERVICE:
To guarantee your reservation we require 100% of our service fee 2 weeks prior to your first scheduled service. For service scheduled in less than 2 weeks, 100% of our service fee is due at the time of booking.
Late Fee:
In the event that the service fee is not paid by 5 days after its due date, a $20 late fee will apply. In the event that the service fee is not paid by 10 days after its due date an additional $5 PER DAY will apply up to $100 in total late fees ($20 initial late fee and then $80 remaining late fees). Service will be refused for any client with an outstanding balance that is 10 or more days past due and must be made current and in good standing including all recent charges before service can resume. Should any court action be needed to collect the amount due the client in delinquent status will also be responsible for any and all court costs, fees, and legal counsel.
Cancellation Policy:
o MEMBERSHIP DOG WALKING:
Cancellations are due by 6 a.m. the day of a scheduled walk. the Client will be credited the service fee for the cancelled visit, less any discounts that were originally applied to that visit. Additional charge may apply for remaining visits that were part of the discount. If the visit is cancelled after 6 a.m., Client will forfeit the service fee. Day or Time "swapping" subject to handling fee.
Cancelling more than 10 walks in any one month will result in a $10 per-visit-cancelled as retainer fee to keep your membership active and time slot saved or cancellation of membership in cases of multiple subsequent months with the same or more cancellations. To cancel or change membership level please submit cancellation/change notice, in writing, at least 14 days prior to the first day of the next month to office@executive-pet-services.com.
o SUBSCRIPTION DOG WALKING:
Cancellations will not alter the set service fee for the month and no services will be offered in place of or to "make up" cancelled services.
o AD HOC DOG WALKING:
Reservations are final when requested by you and accepted by us. Cancellations will forfeit any service fees associated with that service.
o PACK ADVANTAGE or PACKAGED DOG WALKS:
Cancellations are due by 5pm the day previous to the service to receive the service credited back to the package. Services cancelled after this will not be credited back to the package and will be considered as having used the service.
o PET SITTING AND OVERNIGHT SERVICE:
Cancellations are due 14 days prior to the start of the first visit. If cancelled within 14 days of the start date, Client will be responsible for 50% of the invoice for booked/confirmed services. If cancelled within 7 days of the start date, Client will be responsible for 100% of the invoice for booked/confirmed services. This also apply to services that are cut short, for instance, if the Client returns early and cancels remaining services.
Holiday reservations are final.
Any amount already paid, but owed to the client will be credited to the client's ExecuPets account for future service.
Returned Transactions/Insufficient Funds:
There will be a $20 service charge for each returned transaction, including check and debit/credit card transactions.
Responsibilities and Liabilities:
o Executive Pet Services is not responsible for damage to the home beyond the control of the Pet Sitter. This includes, but is not limited to leaks, electrical problems, and acts of nature. In these situations, the company will attempt to contact the client and then the emergency contact before making a subjective decision on dealing with the problem. All repairs and related fees (including Special Service emergency service time and coordination fees) will be paid by the client, or fully reimbursed to Executive Pet Services upon return.
o Executive Pet Services is not responsible for any damage to the property of the client or others unless such damage is caused by the negligent act of the Pet Sitter.
o Executive Pet Services asks that, should there be other individuals visiting the home during our service period, (this includes but is not limited to, family, friends, service people) that we be notified that such persons may be present. Executive Pet Services can not to be held responsible for pets being cared for by other individuals. Client agrees to hold harmless and indemnify Executive Pet Services from damage, losses, accidents cause by such persons.
o Executive Pet Services is not liable for any loss or damage in the event a burglary or other crime that should occur while under this contract. Pet Owner agrees to secure home prior to leaving the premises. Executive Pet Services will re-secure the home to the best of its ability at the end of each visit. While keys are in the possession of a Pet Sitter, they will be either on the Sitter's physical person, or be properly stored in an undisclosed location.
o Pet Owner must have legal rights to place the animals in the care of Pet Sitters, Kennels, and Veterinary Clinics. Executive Pet Services cannot service a home with “Visiting” pets or animals that do not belong to the resident of the service site without separate sets of agreement forms, including a Service Agreement, accepted and signed by each rightful owner(s). An additional pet fee may apply for visiting pets.
o Pet Owner is responsible for pet-proofing house and yard, and the security fences/gates/latches. Executive Pet Services will not be responsible for the safety of any pets and will not be liable for the injury, disappearance, death, or fines of any pet with unsupervised access to the outdoors.
o Executive Pet Services, LLC is authorized to seek any emergency veterinarian assistance needed during visits, at the cost of the client, from any veterinarian as chosen by the sitter. However, the company is not responsible for the health/well being of the animal while under the care of the veterinarian.
o Pet Owner is responsible for supplying the necessary, safe equipment/supplies needed for care of their pet(s), including but not limited to a sturdy, well-fit harness (halter, collar, etc…) for walks or in case of emergencies, firmly affixed vaccination tags, a lead rope or leash, pooper-scoopers, litter boxes, food, cleaning supplies, medicines, pet food, and cat litter. Pet Owner authorizes any purchases necessary for the satisfactory performance of duties. Pet Owner agrees to be responsible for the payment of such items, as well as service fees for obtaining items, and will reimburse Executive Pet Services upon return.
o Pet Owner will be responsible for all medical expenses and damages resulting from an injury to a Pet Sitter, or other persons, by the Pet. Customer agrees to indemnify, hold harmless, and defend Executive Pet Services, llc, in the event of a claim by any person injured by the Pet.
o It is suggested that arrangements be made with someone to evacuate your pets in case of a disaster or weather related event/crisis. Executive Pet Services will definitely try to see to your pets safety/care should such events occur, but cannot guarantee it.
o Client agrees to provide TWO (2) working keys or “modes of entry” to Executive Pet Services. Modes of entry can include the following or other mutually agreed upon arrangement:
Free Standing Homes & Apartments/Condos with direct, private access:
You will need to provide two (2) copies of physical keys. One is an emergency backup. Keys are coded with an internal number and stored in a secured location. -OR-
Provide a DOOR CODE if you have an electronic lock. Please note, if power or batteries fail, we may not be able to enter your residence to care for you pets. You may want to keep a physical key on file with us for emergencies.

Purchase a key (realtor-type) lock box and hang it where ever you prefer for us to retrieve the key and replace when your service is finished for the day. You will need to keep your lock box code updated in our Pet Portal.
Apartment Buildings with 24 hour Concierge/Security Service:
You should be able to leave a key or key fob with your concierge for us to pick up and return at each visit.
If your building has a door code for the primary entry point, you will need to provide us one so that we may enter your building.
Apartment Buildings without Concierge Service:
You will need to provide two (2) copies of physical keys or key fobs. One is an emergency backup. Keys are coded with an internal number and stored in a secured location. If your building has a door code for the primary entry point, you will need to provide us one so that we may enter your building. Some buildings allow for the key fob to access it.
o Client can and are encouraged to request that Executive Pet Services keeps the client's key on file, so that service can be scheduled in short need. If client chooses to have key returned after service and/or picked up prior to service, a $10.00 service fee will apply.
• Executive Pet Services, llc may substitute sitters as needed to accommodate for business needs and/or sitter illness and injuries or for “last minute” requests without notice.
• Executive Pet Services, llc reserves the right to terminate this contract at any time if the Pet Sitter, in his/her sole discretion determines that Owner's pet poses a danger to the health or safety of itself, other pets, other people, or the Pet Sitter. If concerns prohibit the Pet Sitter from caring for the pet, the Owner authorizes the pet to be placed in a kennel (or previously arranged locale), with all charges (including but not limited to transportation, kenneling, tranquilizing, treating, accessing, and liability) to be the responsibility of the Owner.
• Executive Pet Services, llc agrees to provide services stated in this agreement in a reliable, caring and trustworthy manner. In consideration of the services as an express condition thereof, the client expressly waives and relinquishes any and all claims against the company and its employees, except those arising from negligence. Claims of negligence that involve a hired Independent Contractor, hired by Executive Pet Services, will be the responsibility of the Independent Contractor and the company they represent. All hired Independent Contractors are required to carry liability insurance with optional coverage or bonding through a reputable company.
• Client agrees to notify Executive Pet Services, llc of any concerns within 24 hours of return.
• Client agrees to notify Executive Pet Services, llc upon return from vacations or out-of-town trips when client is safely in their home. Executive Pet Services may automatically make additional visits if not notified by the next normally scheduled visit time. Client agrees to pay for additional services upon receipt of invoice.
• The terms of this document apply to all the pets owned by the client, including any and all new pets that the customer obtains on or after the date this document was signed, at any and all locations the owner designates for service.
• Future Services: Client authorizes this contract to be valid approval for services so as to permit Executive Pet Services, llc to accept all future telephone, online, mail or email reservations and enter my home without additional signed contracts or written authorizations.
• This agreement is valid from the date signed, and replaces any prior Service agreements. Client agrees to any future Executive Pet Services,llc term changes relayed verbally to the client, mailed or emailed in writing to the client, or posted on our website under the heading Polices.
• The owner states that he/she has read this agreement in its entirety and fully understands and accepts its terms and conditions.Veterinary Release Agreement VETERINARY RELEASE AGREEMENT

For the purposes of this document, the terms "We", "Us", and "Company" are synonymous with Executive Pet Services.
For the purposes of this document, the terms "Pet Sitter", "Sitter", "Care Provider" and "Employee" are synonymous with any individual contracted, employed by or an agent of Executive Pet Services.
In the event that any of my pets or large animals appears to be ill, injured, or at significant risk of experiencing a medical problem at the start of service or while in the care of Executive Pet Services, I give permission to Executive Pet Services to seek veterinary service from a veterinarian or a veterinary clinic. Any Veterinarian or emergency care clinics chosen by the pet sitter are acceptable for emergency care.
I ask Executive Pet Services to inform the attending clinic or veterinarian of my requested total diagnosis and treatment limit, per pet (most common values are $200, $1000, or unlimited) as defined in my pet's profile in the Executive Pet Services Client Portal. I understand that efforts will be made to contact me regarding any treatments, illness, injury, or potential problems as soon as the condition is deemed not life threatening and/or contact is possible. I understand that Executive Pet Services care providers work hard to prevent accidents and injuries, and that such problems may occur no matter how well a pet is cared for. I agree to allow Executive Pet Services care providers to use their best judgment in handling these situations, and I understand that Executive Pet Services and its staff assume no responsibility for the actions and decisions of the veterinary staff, the health, or death of my pet(s).
I will assume full responsibility for the payment and/or reimbursement for any and all veterinary services rendered, including but not limited to diagnosis, treatment, grooming, medical supplies, and boarding. Such payments will be made upon return of pet owner. I also agree to be responsible for all Special Service fees assessed by Executive Pet Services for emergency transportation, care, supervision, or hiring of emergency caregivers, and will pay such fees upon return of pet owner.
I further authorize Executive Pet Services and my primary veterinarian(s) to share all of the medical records of all of my animals with veterinary clinics in an emergency in the interest of providing the best care for my ill or injured animal(s).
Every pet or animal at the site of service will be current (per my veterinarians recommendations) on its vaccinations prior to the arrival of any caregiver. I will also make arrangements to guarantee that each animal will remain current on its vaccinations throughout each service visit period.
I agree to notify Executive Pet Services of any signs of injury or possible illness before any visit as soon as the condition appears. Executive Pet Services reserves the right to cancel service at any location where a pet with a potentially infectious condition exists. Executive Pet Services strives to provide clean, safe service to each of our clients. In doing so, Executive Pet Services strongly recommends that each pet and large animal be vaccinated, de-wormed, and protected from harmful insects according to veterinarian recommended standards.
This agreement is valid from the date below and grants permission for future veterinary care without the need for additional authorization each time Executive Pet Services cares for one or more of my pets. I understand that this agreement applies to all of the pets and large animals within Executive Pet Services care. In signing this contract, I agree that I have the sole authority to make health, medical, and financial decisions regarding the animals that will be scheduled to receive service.By clicking "Agree & Submit" you are confirming your acceptance of these policies.
